| Individual or family group compensation

Vale signed a Commitment Agreement with the Public Defender's Office of Minas Gerais to expedite the payment of compensation for the collapse of Dam I, at the Córrego do Feijão mine. This commitment agreement serves as a parameter for compensations related to the evacuation of the Sul Superior dams, in Barão de Cocais, and B3/B4, in Macacos and allows residents to voluntarily negotiate their compensations. 

Deadline for requesting entry into the Extrajudicial Individual Compensation Program 

The deadline for new requests for entry into the Extrajudicial Individual Compensation Program (civil damages) related to the collapse of Dam B1, at the Córrego do Feijão mine, in Brumadinho, ended on January 24, 2022. 

Evacuated municipalities: 

Vale communicates the deadlines for new requests for entry into the Extrajudicial Individual Compensation Program (civil damages) referring to emergency evacuations that occurred due to the elevation of the emergency level of the Sul Superior dams (Gongo Soco mine, in Barão de Cocais); B3/B4 (Mar Azul mine, in Macacos, Nova Lima district); Forquilha III (Factory mine) and Vargem Grande (Rio de Peixe region, Nova Lima).

Until the dates above, it is possible to make an appointment through a lawyer, a meeting to join the Extrajudicial Individual Compensation Program in these municipalities.

Appointments must be made via telephone call, from Monday to Friday, during business hours (9 am to 5 pm) at the contact numbers above.  For appointment, information sent by e-mail, WhatsApp or in list/spreadsheet format is not accepted. 

Vale reinforces its commitment to those and reaffirms that requests in progress, as well as those initiated until the deadlines for each location, will normally follow the program procedure, with a subsequent response from the company.

The following documents must be presented at the meeting, considering all claimants (adults and minors) who are related to the claimed damages.

  • CPF - Taxpayer Registration Number (except minors who do not yet have CPF)
  • RG - Identity Card, CNH - driver's license, work card or passport (to verify, among other data, date of birth and parents’ names)
  • Birth certificate (for minors, if they do not have a RG)
  • Custody agreement (minors with divorced parents) / Guardianship agreement (minors with absent/deceased parents) / Curator agreement (over 18 years old without civil capacity)
  • Marital status
  • Stable Union Certificate and/or Updated Marriage Certificate (registration/record at the registry office until 01.25.2019, to verify the matrimonial regime)
  • Last change date
  • Proof of residence (example: water or electricity bill for the month of January/2019 or later, with consumption history covering January/2019.)
  • Power of attorney on behalf of all claimants and with sufficient powers to make settlements extrajudicially (suggestion of model can be obtained from the facilitation office)
  • Power of attorney on request for illiterate/bedridden individual
  • Copy or original of the lawyer's OAB (Order of Attorneys of Brazil)

Official documents must be presented in the original or notarized copies, representing the updated version of the respective documents. Statements must be presented with a notarized signature.

The following documents must be presented at the meeting, for legal entity claims that are related to the claimed damages.

  • Individual taxpayer's registration number - CNPJ card
  • Articles of Incorporation / Bylaws
  • In the case of a Public Limited Company, documentation proving the powers of the company's representative (for example: minutes of the Board of Directors' meeting or the Shareholders' Meeting)
  • Power of attorney on behalf of the Company, with sufficient powers to make settlements in the extrajudicial scope (suggestion of a model can be obtained from the facilitation office)
  • Copy or original of the lawyer's OAB (Order of Attorneys of Brazil)

In order for the request for compensation to be dealt with more quickly and effectively, it is important that the claimant appears at the facilitation office supported by all documentation capable of proving the facts described in his/her narrative, as well as the damages, loss suffered and their values.

This documentation can be composed of official documents (proving ownership, income, certificates, etc.), as well as photos, receipts, videos, among others that demonstrate the situations and alleged losses.

| Emergency Payments

In October 2021, Vale concluded the escrow deposit of the total amount foreseen for the Income Transfer Program - R$ 4.4 billion - adjusted by the IPCA until August 2021 and deducting operating costs and emergency payments between June and October 2021, as provided for in the Comprehensive Reparation Agreement signed in February this year between the Government of Minas Gerais, Federal and State Public Prosecutor’s Offices, State Public Defender's Office and the company.

This is the definitive solution for the emergency payment made by Vale to those affected by the collapse of the Brumadinho dam. As of November 1st, the terms of the new Income Transfer Program, created and managed by the Justice Institutions, without the participation of Vale, will take effect. The Justice Institutions are responsible for defining participation criteria, payments and program management. As disclosed on the website of the Government of Minas Gerais – (www.mg.gov.br), doubts regarding the PTR can be clarified through the exclusive service channel of FGV: PagamentoPTR@fgv.br.


How to proceed in case of cancellation of registration and return of amounts received improperly

Those interested in returning amounts received improperly must deposit the amount received in Vale's current account. After making the deposit, they must go to one of Vale's Compensation Registration Centers (PRI) , in possession of a photo identification document, to deliver the deposit slip.

If you do not have a Vale Compensation Registration Center (PRI) in the city, you will need to go to the nearest Registration Center. After delivery of the deposit slip.

Deposits must be made in an identified way, containing the CPF of the person responsible for the return, through the Bank DOC [Credit Document], TED [Electronic Transfer Available] and bank transfer modalities. Deposits via envelope or at the branch cashier do not have identification and therefore should not be used.

| Workers' compensation

On July 15, 2019, Vale and the Public Labor Prosecution Office of Minas Gerais signed an agreement through which the discovery phase of the Public Civil Action was ended. From this date onwards, the families of workers who were victims of the dam I collapse, at the Córrego do Feijão mine, in Brumadinho, will be able to qualify for compensation, starting the execution of the individual agreement.

  • Parents, spouses or companions and children of deceased workers will receive, individually, R$ 500,000 for moral damages. Siblings will receive R$ 150,000
  • There will be the payment of an additional insurance for work accident in the amount of R$ 200,000 to parents, spouses or companions and children, individually
  • There will also be the payment of material damages to the group of dependents, whose minimum value is R$ 800,000
  • A daycare allowance in the amount of R$ 920 per month will be paid for children of deceased workers up to 3 years of age, and education allowance in the amount of R$ 998 monthly for children between 3 and 25 years of age
  • Lifetime health insurance will be granted for spouses or companions and for children up to 25 years of age
  • The agreement also provides stability to Vale workers and outsourced workers, assigned to the Córrego do Feijão Mine on the day of the dam collapse, and to survivors who were working at the time of the collapse, for a period of 3 years, counted from January 25, 2019, can be converted into pecuniary
  • On August 6, 2019, Vale will deposit at the disposal of the court the amount of R$ 400 million as collective moral damages
Workers Compensation with surviving or hired workers

In March 2020, as a result of the collapse of Dam I, of the Córrego do Feijão mine, in Brumadinho, Vale and six Unions* signed an agreement in the Public Civil Action for the purpose of paying compensation to the hired and surviving workers.

*Trade unions involved:

  • Union of Workers in Heavy Construction Industries of Minas Gerais – SITICOP;
  • Union of Employees in Collective Meal Companies of Minas Gerais – SEERC/MG;
  • Union of Employees in Cleaning, Conservation and Urban Cleaning Companies in the Metropolitan Region of Belo Horizonte – SINDI ASSEIO RMBH;
  • Union of Employees of Safety and Asset Surveillance Companies - SESVESP, etc. of Minas Gerais;
  • Union of Workers in Production, Organization and Event Projects Companies in the State of Minas Gerais – SINTETOPE/MG;
  • Federation of Workers in the Construction and Real Estate Industries of the State of Minas Gerais – FETICOM/MG.

Assumptions for receiving the reparation

  • The surviving employees, who are the Vale and outsourced workers who were working at the Córrego do Feijão Mine at the time of the B1 dam collapse, (10/25/2019 at 12:28 pm), regardless of the formal functional role, will receive R$100,000 for moral damages, R$150,000 for material damages and psychiatric and psychological treatment, in an accredited network, until January 2022 or while the employment contract that already includes the same benefit lasts;
  • The hired employees, who are those workers, both for Vale and outsourced, with an active contract on 01/25/2019, and who actually worked at the Córrego do Feijão Mine, although they were not in that establishment at the exact moment of the B1 dam collapse, and who are not hired in other Vale units or in other locations defined by their employers, even if, occasionally, they have provided services at the Córrego do Feijão Mine and/or Jangada, they will receive R$ 40,000 for moral damages, R$ 40,000 for materials damage;
  • Employees on leave, which are those workers, both for Vale and outsourced, who, on the date of the B-1 dam collapse (01/25/2019), were on leave for more than 30 (thirty) days, will receive R$ 20,000 for moral damages, R$ 20,000 for material damages.

How do I register to receive workers' compensation?

The family members covered by the agreement signed may use union lawyers, private lawyers or even look for the Sector of Hearing of the Labor Court of Betim (MG), to join the Public Civil Action, whose claim has the number 0010261-67.2019.5.03.0028 and is being processed at the 5th Labor Court in Betim (MG).
