Indemnification

Those affected by the breach of Dam 1, at Córrego do Feijão mine, in Brumadinho, can register for one of the types of indemnity – individual, emergency, and labor. Below, learn about the differences, who is eligible for each type of indemnity, and how to complete the request process.

| Individual or family Indemnities

Vale signed an Agreement with the Public Defender's Office of Minas Gerais to expedite the payment of indemnities regarding the breach of Dam 1, at Córrego do Feijão mine. This Agreement serves as a parameter for indemnities related to the evacuation of Sul Superior dam, in Barão de Cocais, and B3/B4 dams, in Macacos. In addition, it allows residents to negotiate their indemnities voluntarily.

To begin the negotiation process, applicants must pre-schedule an appointment at one of the Indemnity Offices listed below, and provide all required documentation.

Documentation about Damage Evidence

All applicants (adults and minors under the age of 18) that are related to the claimed damages must submit the following documents at the meeting.

  • Individual Taxpayer Registration Number Card (except minors)
  • ID Card, Driver's License, Labor and Social Security ID Card, or Passport (among other data, such as date of birth and parents' names)
  • Birth Certificate (for minors under the age of 18 without ID Card)
  • Custody Agreement (for minors under the age of 18 with separated parents), Guardianship Agreement (for minors under the age of 18 with missing/deceased parents), Conservatorship Agreement (over the age of 18 without civil capacity)
  • Marital status
  • Declaration of Stable Union and/or updated Marriage Certificate (registration/annotation at the Notary Public Office until January 25, 2019, for the Matrimonial Property Regime)
  • Last modification date
  • Proof of residence (such as utility bills from January, 2019 or later, with consumption history including January, 2019)
  • Power of attorney on behalf of all applicants, with sufficient powers to make settlements at extrajudicial level (a template is available at the Indemnity Offices)
  • Power of attorney for illiterate/bedridden
  • Copy or original document from lawyer's member registry at the Brazilian Bar Association (OAB)

Official documents must be submitted in original or certified copies representing the updated version of the respective documents. Declarations must be provided with notarized signature.

Legal entities that are related to the claimed damages must submit the following documents at the meeting.

  • Corporate Taxpayer Registration Number Card
  • Articles of Incorporation/By-Laws
  • In the case of a Corporation, documentation proving the powers of the company's representative (such as Minutes of the Board of Directors' or Members' Meeting)
  • Power of attorney on behalf of the Company, with sufficient powers to make settlements at extrajudicial level (a template is available at the Indemnity Offices)
  • Copy or original document from lawyer's member registry at the Brazilian Bar Association (OAB)

In order to expedite the indemnity request, it is important that the applicants go to an Indemnity Office and provide all the documentation that prove the facts described in their statements, as well as the damages, losses, and respective values.

This documentation may consist of both official documents (proving ownership, income, certificates, etc.), as well as photos, receipts, videos, among others, to prove the alleged losses and conditions.

| Emergency Compensation

Vale pays the emergency compensation established by the Preliminary Agreement to the residents of Brumadinho and those located within 1km of Paraopeba river channel, from Brumadinho to the city of Pompéu, at Retiro Baixo dam.

Emergency Compensation Registration Centers

Check below the complete list of addresses of the Emergency Compensation Registration Centers where the person who receives the benefit can be assisted to update bank account documents and inventory documentation in case of death of the applicant.

Important: New registrations for the payment of emergency compensation to those affected by the breach of dam I are not being accepted since 11/28/2019, date of approval of the extension of payment for another 10 months

How to Cancel Registration and Return of Improperly Received Amounts

Those interested in returning the improperly received amount must make a deposit in Vale's bank account. After the deposit, stakeholders must go to one of Vale's Indemnity Registration Center – and provide an identification document with photo – to submit the proof of deposit.

If there is no Indemnity Registration Center in your city, you will need to go to the nearest Center. Upon submission of the proof of deposit and signatures of the required terms, the amounts will no longer be deposited monthly to the accounts of the stakeholders.

| Labor Indemnities

Vale and the Labor Prosecution Office of Minas Gerais signed, on July 15, 2019, an agreement whereby the phase of knowledge of the public-interest civil action was concluded. From this date, the families of workers who were victims of Dam 1 breach at Córrego do Feijão mine, in Brumadinho, will be entitled to receive compensation, by means of individual agreement.

Compensation Assumptions

  • Parents, spouses or partners and children of deceased workers will receive R$500,000, individually, for moral damage. Siblings will receive R$150,000
  • There will be an additional occupational accident insurance of R$200,000 for parents, spouses or partners and children individually
  • Compensation for material damage, whose minimum amount is R$800,000, will also be paid to the dependents per family
  • Daycare assistance of R$920 per month for children of deceased workers up to 3 years old, and educational assistance of R$998 per month for children between 3 and 25 years old, will also be paid
  • Medical insurance will be provided to spouses or partners (life-long) and children up to 25 years of age
  • The agreement also provides for stability to direct and third-party employees working at Córrego do Feijão on the day of the breach, and to survivors who were working at the time of the breach, for a period of 3 years from January 25, 2019, but it can be converted in money
  • Vale will deposit at the court's discretion, on August 6, 2019, the amount of R$400 million as collective moral damage

How to Register to Receive Labor Indemnity

Family members contemplated by the agreement can appoint a lawyer from union, a private lawyer, or the Labor Court of Betim (Minas Gerais) to join the Public-Interest Civil Action – process number 0010261-67.2019.5.03.0028 –, which is in the 5th Labor Court of Betim (Minas Gerais).
